By downloading, installing, or using the Helian mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Helian is an AI-powered nutrition tracking application that provides:

• Photo-based meal analysis using artificial intelligence
• Nutritional information and calorie tracking
• Integration with Apple HealthKit
• Progress tracking and goal setting features

The App is provided for informational purposes only and should not be considered medical or nutritional advice.

3. User Accounts

You may be required to create an account using Sign in with Apple to access certain features. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Providing accurate and complete information

4. Subscription and Payments

4.1 Free Tier

Helian offers limited free functionality, including up to 15 AI meal analyses per month.

4.2 Premium Subscription

Premium features are available through auto-renewable subscriptions purchased via the App Store. Subscriptions include:

• Unlimited AI meal analyses
• Ad-free experience
• Priority support
• Advanced features and insights

4.3 Billing

Payment will be charged to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

4.4 Cancellation

You can manage or cancel your subscription through your App Store account settings.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its servers
• Interfere with or disrupt the App's functionality
• Upload malicious code or content
• Use the App to harass, abuse, or harm others
• Reverse engineer or attempt to extract the source code

6. Health and Medical Disclaimer

Important: Helian is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The nutritional information provided is estimated and should not replace professional medical advice.

Always consult with a qualified healthcare provider before making any dietary changes or if you have specific health concerns.

7. Accuracy of Information

While we strive to provide accurate nutritional analysis through AI technology, we cannot guarantee 100% accuracy. Nutritional values are estimates based on image recognition and may vary from actual values.

8. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Helian and are protected by copyright, trademark, and other intellectual property laws.

9. Privacy and Data Use

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

10. HealthKit Integration

The App integrates with Apple HealthKit to read and write health-related data. You control which data the App can access through your device settings. We do not use HealthKit data for advertising or marketing purposes.

11. Third-Party Services

The App uses third-party services including:

• Third-party AI services for meal analysis
• Apple services for authentication and payments
• Cloud services for data storage and synchronization

These services have their own terms and privacy policies.

12. Limitation of Liability

To the maximum extent permitted by law, Helian and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App.

13. Indemnification

You agree to indemnify and hold harmless Helian and its affiliates from any claims, losses, damages, liabilities, and expenses arising from your use of the App or violation of these Terms.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
